Standardized Operating Procedures for Purchasers of Real Estate Pursuant to Real Property Law § 442-h

New York Real Property Law § 442-h requires every licensed real estate broker to institute standardized operating procedures describing the prerequisites a prospective homebuyer must meet before receiving any services, and to post them on each publicly available website and mobile application the broker maintains.

NYREFCO, LLC does not require:

  1. Prospective homebuyers to show identification.1, 2
  2. An exclusive buyer broker agreement.1, 3
  3. Pre-approval for a mortgage loan, or proof of funds.2

1 A prospective purchaser who wishes to be represented by this office — that is, to become a client rather than a customer — will be asked to enter into a written representation agreement, and photograph identification will be required at that point.

2 Although this office does not require it, a seller, a landlord, or a property’s listing broker may require identification, a pre-approval letter, or proof of funds before a property is shown or before an offer is considered. Those are lawful instructions and this office will follow them.

3 Diallo J. Stevens separately holds a license as an associate real estate broker with a REALTOR®-affiliated firm. When he is acting under that affiliation rather than for NYREFCO, LLC, that firm’s standardized operating procedure governs, and the rules of the multiple listing service involved may require a written buyer agreement before a property is toured.

What this document is, and is not

These are NYREFCO, LLC’s own prerequisites. This document does not limit what a third party may require, and it is not a representation agreement, an agency disclosure, or a contract of any kind. Whether this office represents you, and on what terms, is set out in a separate written agreement.

A date-stamped and notarized original of this procedure is maintained in the records of NYREFCO, LLC, and a copy is available to the public upon request.
